Terms of Service

By accessing or using the Clonizer.io platform ("Service"), operated by Clonizer ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

We reserve the right to update or modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.

You must be at least 18 years of age to use the Service. By creating an account and using Clonizer, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

To use the Service, you must create an account using Google OAuth through Firebase Authentication. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

You agree to provide accurate and complete information during registration and to keep your account information up to date. You must promptly notify us of any unauthorized use of your account.

Clonizer operates on a credit-based billing system. There are no subscriptions or recurring charges. You purchase credit packs at the prices listed on our platform at the time of purchase, and credits are deducted from your balance when you generate content.

Each AI model has its own credit cost per generation, which is displayed before you initiate a generation. Credit costs may vary based on the model, output resolution, duration, and other parameters.

Clonizer may, at its sole discretion, offer promotional or complimentary credits from time to time. Any such credits are subject to the same terms as purchased credits, may be modified or withdrawn at any time, and may not be transferred or redeemed for cash.

Purchased credits do not expire unless your account is terminated in accordance with these Terms. Credits are non-transferable between accounts.

Credits are digital goods that are delivered instantly upon successful payment confirmation. By completing a purchase, you acknowledge that credits are immediately added to your account and are available for use right away. Charges will appear as "CLONIZER" on your payment statement.

All credit purchases are final and non-refundable once credits have been used. Due to the nature of AI generation, results may vary and subjective dissatisfaction with a generation does not constitute grounds for a refund.

If a generation fails due to a technical error on our end (such as a server failure, model timeout, or processing error), the credits consumed for that generation will be automatically refunded to your account balance. This automatic refund typically occurs within a few minutes of the failed generation.

For unused credit balances, refund requests may be considered on a case-by-case basis within 14 days of purchase by contacting our support team. We reserve the right to approve or deny such requests at our sole discretion.

By completing a credit purchase, you expressly acknowledge and agree that: (a) you are purchasing non-refundable digital goods, (b) credits are delivered instantly upon payment, and (c) you have read and agree to this refund policy.

If you have any billing concerns or believe a charge is incorrect, you agree to contact us first at [email protected] before initiating any payment dispute or chargeback with your bank or payment provider. We are committed to resolving billing issues promptly and fairly. Initiating a chargeback without first contacting us may result in account suspension.

You retain ownership of all content you generate through the Service ("Generated Content"), subject to the underlying AI model providers' terms and applicable law. You are free to use your Generated Content for personal and commercial purposes.

By using the Service, you grant Clonizer a non-exclusive, worldwide, royalty-free license to store, process, and transmit your Generated Content solely as necessary to operate and improve the Service. We will not sell, publicly display, or distribute your Generated Content without your explicit consent.

You are solely responsible for the content you create and how you use it. You represent that your use of Generated Content will comply with all applicable laws and will not infringe upon the rights of any third party.

Any input content you upload (such as reference images for image-to-video generation) remains your property. You represent and warrant that you have all necessary rights to any content you upload to the Service.

You agree not to use the Service to:

• Generate, distribute, or promote content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable under applicable law.
• Create deepfakes, synthetic media, or any AI-generated content depicting real individuals without their explicit, informed consent.
• Generate any adult, pornographic, sexually explicit, or otherwise NSFW content of any kind. All prompts and outputs pass automated content moderation; attempts to generate such content are blocked and repeat violations result in account termination.
• Generate child sexual abuse material (CSAM) or any sexually explicit content involving minors. This is strictly prohibited and will result in immediate account termination and reporting to law enforcement.
• Produce content that promotes terrorism, violence, self-harm, or incites hatred against any individual or group based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics.
• Create fraudulent, misleading, or deceptive content intended to manipulate public opinion, interfere with elections, or spread disinformation.
• Infringe upon or violate any intellectual property rights, trademarks, or copyrights of any third party.
• Attempt to reverse-engineer, decompile, or extract the underlying models, algorithms, or source code of the Service.
• Use automated scripts, bots, or other means to access the Service in a manner that exceeds reasonable use or places undue burden on our infrastructure.
• Resell, sublicense, or redistribute access to the Service or its underlying API without prior written authorization.
• Circumvent or attempt to circumvent any content moderation, safety filters, or access controls implemented by the Service.

We reserve the right to review Generated Content for compliance with these Terms and to take action, including content removal and account suspension, if violations are detected.

Clonizer provides access to AI models developed and maintained by third-party providers, including but not limited to OpenAI, Google, ByteDance, Kuaishou, MiniMax, Black Forest Labs, Stability AI, and others. We act as an intermediary platform that facilitates access to these models.

We do not develop, train, or control the underlying AI models. The availability, quality, and capabilities of third-party models may change without notice. We do not guarantee the accuracy, reliability, or suitability of any output produced by these models.

Your use of content generated through third-party models may also be subject to the respective model providers' terms of service and acceptable use policies. It is your responsibility to review and comply with any applicable third-party terms.

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, timely, secure, or error-free. AI generation times, quality, and model availability may vary. We may perform scheduled or unscheduled maintenance that temporarily affects Service availability.

We are not responsible for any losses, damages, or costs arising from Service downtime, failed generations (beyond automatic credit refunds), or changes to available models and features.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to provide advance notice of significant changes.

To the maximum extent permitted by applicable law, Clonizer and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Service.

Our total aggregate liability to you for any claims arising from or related to these Terms or the Service shall not exceed the total amount you have paid to Clonizer in the twelve (12) months preceding the event giving rise to the claim.

You may delete your account at any time through the account settings or by contacting our support team. Upon deletion, your account data and generation history will be permanently removed in accordance with our Privacy Policy. Any remaining unused credits will be forfeited upon account deletion.

We reserve the right to suspend or terminate your account at any time, with or without notice, if we reasonably believe that you have violated these Terms, engaged in prohibited uses, or if your continued use poses a risk to the Service, other users, or third parties.

In cases of severe violations (such as generating CSAM or content promoting terrorism), your account will be terminated immediately without notice, and we may report the violation to appropriate law enforcement authorities.

You agree to indemnify, defend, and hold harmless Clonizer and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Service, your Generated Content, your violation of these Terms, or your violation of any rights of any third party.

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the Service shall be resolved through good-faith negotiation between the parties. If negotiation fails, disputes shall be submitted to binding arbitration or the competent courts of the applicable jurisdiction.

If any provision of these Terms is found to be invalid, unenforceable, or illegal by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
